Do Mothers Always Get Custody In Pasco County, Florida Divorces?

This is common question I get asked by Fathers about the children involved in a divorce. In past decades, courts have had a tendency to favor mothers when considering child custody arrangements.

This was especially true for younger children. However, Pasco County, Florida courts now do not favor one parent over the other based on gender.

Instead of basing child custody on gender, courts use a variety of factors that affect the welfare and interests of the child. The goal of awarding child custody between parents is to do what’s in the best interests of the child. Some factors that courts consider in deciding custody arrangements include:

- The moral fitness of the parents;

- The emotional relationship between the parents and the child;

- The length of time the child has lived in a stable environment and the desire that the child continue living in a stable environment;

- The ability of the parent to provide the child with basic needs, including clothing, food, medical care, and other material needs;

- The permanence of the custodial home;

- The physical and mental health of the parents;

- The preference of the child, if the child is old enough and mature enough to express a preference;

- Domestic abuse or violence; and

- Other relevant factors.

Although in many cases, the mother is awarded more custodial time with the children, that is not true in all cases. If you are a father and you believe you would be the better custodial parent, you should stand up for your rights and what’s in the best interests of your children.
